Housing Disrepair: Client Story – Home Loss Payment
Bond Turner’s Housing Disrepair Team supported a client who was re-housed on a permanent basis due to the level of disrepair in their property.
We were able to secure home loss payment for the claimant in addition to breach of contract and damages for the distress, inconvenience and loss of enjoyment while living in such conditions, totalling over £20,000. The case was managed by Trainee Solicitor Marta Pawlowska.
Our client
The client had lived in a state of disrepair for some years, with records of complaints dating back as far as six years. Our survey identified a number of problems with the home both externally and internally.
The tenant was living with damp to the walls and skirting boards, with damaged plaster and deteriorating décor apparent across a number of rooms including the living room, back room, bathroom and bedrooms, with one bedroom showing signs of mould growth. It was determined that the windows were rotting throughout the property and the radiators were inadequate.

The claimant is now waiting to sign a tenancy on a new, more suitable property, with Bond Turner able to secure home loss payment, in addition to further compensation for the landlord’s breach of contract and damages.
We were able to secure an interim payment for our client and have agreed with the defendant that the move to be completed within six months. The defendant will replace the kitchen in the new property in readiness for our client to move in.
