Housing Disrepair: Client Story – water penetration, severe damp and mould

Our Client

Our client lived in a three-bedroom maisonette. They had a number of issues in the property, including water penetration, severe damp and mould causing damage to the walls and furniture in the property. The issues in the property were causing our client a lot of concern as she lived there with her daughter who has sickle-cell anaemia and asthma and she was concerned that living with the damp and mould would negatively impact her health.

Bond Turner were able to provide expert evidence after instructing a chartered surveyor to the property, who found £3,296.82 worth of repairs. The Defendant stopped engaging with us and so we were forced to issue Court proceedings. The Defendant failed to engage with proceedings and so we made an application for default judgement, which was successful and the Judge ordered the Defendant to carry out the repairs in the property. The Court then listed the matter for a disposal hearing. We had made every effort to contact the Defendant and ask them to engage with us to resolve this matter. The Court took a very dim view of the Defendant’s conduct and sympathised with the Client. The claim for damages was valued up to around £6,108, however the Judge awarded damages in the sum of £24,039, which included a penalty for the Defendant’s conduct. The Client was delighted with the outcome.
