What are the different types of damages that can be recovered in a personal injury claim?
There are two types of damages (the amount of compensation you will receive if your claim is successful) – special damages and general damages.
Special damages are designed to compensate a victim of personal injury for out-of-pocket expenses directly related to the accident. These can include money spent on getting to and from the hospital and paying for parking, loss of income due to having to be off work, the repair and replacement of damaged property and short and long-term medical costs. These also include the cost of care and the cost of adaptations that may be required to the home as a result of a serious injury.
General damages are used to compensate the claimant for direct effects of the accidents, such as physical impairment, pain and suffering, mental anguish, and loss of quality of life.
Will I have to go to court?
Because of our experience in managing complex personal injury claims, most of our cases are settled out of court. We are highly experienced in alternative dispute resolution methods such as mediation and negotiation, plus Part 36 offers, and try to employ these strategies to gain an early settlement.
