Can I make a claim under the Fatal Accident Act 1976?
Following a fatal accident, claims can be brought either on behalf of the deceased’s estate or by the deceased’s dependents. Damages that can be claimed include compensation for pain, suffering, and loss of amenity, and any financial losses incurred by the deceased prior to death because of the accident, and funeral expenses.
Under the Fatal Accident Act 1976, dependents can claim for the loss of financial support and for the loss of the deceased’s domestic support, e.g. DIY, household activities, and gardening etc., as well as the costs of childcare if the deceased has left dependent children. Close relatives, including the deceased’s spouse, civil partner or parents of a child under the age of 18, can also claim a statutory bereavement award. In 2017, the Court of Appeal in Smith v Lancashire Teaching Hospitals NHS Foundation Trust1 ruled cohabitees also had a right to claim under the Fatal Accident Act 1976.
