What is rehabilitation in personal injury compensation claims?

The Personal Injury Pre-Action Protocol emphasises the importance of rehabilitation in putting the injured person back to, or as close as possible to, the position they were in prior to their accident.

The Protocol, which must be followed in a personal injury claim, puts an onus on both parties to ensure a claimant has access to medical treatment and support at the earliest possible opportunity.  Alongside seeking compensation for the injuries and losses sustained in an accident, we seek to ensure our clients achieve the best physical and mental recovery within the shortest timeframe.  Insurers are encouraged to offer and fund rehabilitation under the Rehabilitation Code of Best Practice 2015, the aim of which is to facilitate the best recovery and help claimants return to work.

Rehabilitation providers are qualified to assess a claimant’s needs, make recommendations and liaise with insurers to secure appropriate funding is in place.  Assistance can include accessing physiotherapy, counselling treatment, a taxi account, and other help which the NHS cannot readily provide.  Rehabilitation provisions also include ensuring vital aids and equipment are provided to the patient, including, grab rails, shower stools, wheelchairs, mobility scooters, and adapted transport in some cases.  Where serious accidents have resulted in life-changing injuries, accommodation issues can be addressed to tackle difficulties in the home, for example, improving access to the property or bathing facilities.
