What type of injuries require surgery?

Almost any type of injury can require surgery.  For example, a complex fracture may need a surgical procedure to move the bone/s back into the correct place and have a metal rod inserted to fix them there.

Brain and spinal injuries, which are unfortunately common in motor vehicle and motor bike accidents also often require risky, complex surgery.  A patient may have pressure on the brain which must be relieved by draining cerebrospinal fluid from inside the organ.  Spinal injuries may require surgery to decompress the spinal cord or fix the spine in place.

What are the risk associated with surgery?

Surgery always carries a risk.  Not only is there an inherent danger of general anaesthetic, if the surgeon makes a mistake during the procedure, but further injuries can also result.  There is also the risk of infection, including sepsis which can be fatal.

Can I claim for compensation if my injury requires surgery?

If you receive a personal injury which requires surgery, you may be able to claim compensation.  You need to prove the injury you received was due to the negligence of another person, company, or public body.  This requires evidence proving:

  • The person/company/public body who caused your accident owned you a duty of care,
  • They breached that duty, and
  • Their breach of duty caused you damage.
